Terms of Service

The terms that govern your purchase and use of SmartRemote products and services.

1. About these terms

These Terms of Service (Terms) govern your purchase and use of the SmartRemote device, the SmartRemote cloud platform at iot.smartremote.co.za, and any related services (collectively, the Services).

By placing an order or using the Services, you agree to these Terms. Please read them carefully. If you do not agree, do not purchase or use our products or Services.

These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act, 68 of 2008 (CPA) and the Electronic Communications and Transactions Act, 25 of 2002 (ECTA). Nothing in these Terms limits any right you have under applicable South African law.

2. Definitions

  • SmartRemote — the South African business that sells and operates the SmartRemote device and platform.
  • Device — the SmartRemote IoT relay hardware.
  • Platform — the cloud dashboard at iot.smartremote.co.za.
  • You / User — the person or entity purchasing or using the Device or Services.
  • Device Owner — the user who registered and administers a Device on the Platform.
  • Authorised User — a person granted access by a Device Owner to control a Device.

3. Orders and payment

All orders are subject to availability and acceptance by SmartRemote. We reserve the right to refuse or cancel an order at our discretion, in which case we will refund any payment received.

Prices are displayed in South African Rand (ZAR) and are inclusive of VAT where applicable. Prices may change without notice, but changes will not affect orders already confirmed.

Payment must be made in full before dispatch. We use third-party payment processors; we do not store your card details.

4. Delivery

We will endeavour to dispatch orders within the timeframe stated at checkout. Delivery times are estimates and are not guaranteed. Risk in the goods passes to you upon delivery.

If your order is lost or significantly delayed due to our error, we will work with you to resolve the issue, including re-dispatch or a full refund.

5. Returns and the Consumer Protection Act

Your rights under the CPA apply in full.

  • Defective goods: If the Device is defective or does not conform to its description at the time of delivery, you may return it within six months of delivery for a repair, replacement, or refund at your election, in accordance with section 56 of the CPA.
  • Change of mind: If you purchased directly through our website and wish to return the Device in its original, unused condition, please contact us within 7 days of receipt. We will assess the return on a case-by-case basis. Return shipping costs are for your account unless the goods are defective.
  • Direct marketing: If you were approached directly (for example by email or phone) and made a purchase as a result, you have the right under section 16 of the CPA to cancel within 5 business days without penalty.

6. The Device

The SmartRemote Device is sold as a hardware product for integration with compatible electrical equipment, including gate motors, lights, and pumps. Installation involves electrical wiring and must be carried out by a competent person. SmartRemote is not responsible for damage caused by incorrect installation.

The Device requires a 12V DC power supply. It is your responsibility to ensure a suitable supply is available. We offer a compatible power supply as an optional extra.

The Device is designed for use in South Africa on 2.4GHz Wi-Fi networks.

7. The Platform (iot.smartremote.co.za)

Access to the Platform is provided as part of purchasing a Device. We reserve the right to modify, suspend, or discontinue the Platform or any feature thereof, with reasonable notice where possible.

You are responsible for maintaining the security of your Platform account credentials. You must notify us immediately if you suspect unauthorised access to your account.

You must not use the Platform in any way that is unlawful, harmful, or that interferes with the operation of the Service or other users.

8. Messaging services and pay-as-you-go credits

Control via WhatsApp and SMS is routed through third-party messaging gateways. These services operate on a pay-as-you-go basis, meaning a credit balance is required to send and receive messages. SmartRemote will notify you when your balance is low.

Optional voice confirmation for missed call control is similarly charged per use. This feature is disabled by default and must be enabled by the Device Owner.

Telegram, the mobile app, and the web dashboard do not carry per-message costs beyond your standard internet connection.

Credits are non-refundable once consumed. Unused credits may be carried forward but have no cash value.

9. Authorised users

The Device Owner is solely responsible for managing who has access to their Device. By adding a phone number or Telegram user ID to the Platform, the Device Owner represents that they have the consent of that person to receive and respond to messages from SmartRemote on their behalf.

SmartRemote is not responsible for unauthorised access resulting from the Device Owner sharing credentials or adding unauthorised users.

10. Acceptable use

You agree not to:

  • Use the Device or Services for any unlawful purpose.
  • Attempt to gain unauthorised access to any other user's device or account.
  • Interfere with or disrupt the Platform or its infrastructure.
  • Reverse engineer, decompile, or tamper with the Device firmware or Platform software.
  • Resell or sublicense access to the Platform without our written consent.

11. Intellectual property

All intellectual property in the Device firmware, Platform, website, and associated content belongs to SmartRemote or its licensors. Nothing in these Terms grants you any rights in our intellectual property beyond what is necessary to use the Services as intended.

12. Limitation of liability

To the maximum extent permitted by South African law:

  • SmartRemote's total liability to you for any claim arising out of or relating to these Terms or the Services will not exceed the amount you paid for the Device or Service giving rise to the claim.
  • SmartRemote is not liable for any indirect, consequential, or special loss, including loss of data, loss of income, or property damage caused by reliance on the Services.
  • SmartRemote is not liable for interruptions caused by third-party services (including WhatsApp, Telegram, SMS gateways, or internet providers), power outages, or events beyond our reasonable control.

Nothing in these Terms excludes liability for fraud, gross negligence, or any liability that cannot be excluded under South African law, including your rights under the CPA.

13. Privacy

We collect and process personal information in accordance with our Privacy Policy, which forms part of these Terms.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the date at the top of this page. Continued use of the Services after a change constitutes your acceptance of the updated Terms. We will provide reasonable notice of material changes.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms will be subject to the jurisdiction of the South African courts. We encourage you to contact us first to resolve any dispute informally before pursuing formal legal action.
